A warranty question.....

....but perhaps not quite a standard one!

When I bought my RR last September, I got a free 6 month warranty with it. I declined to pay for an extended warranty - I'm allergic to them and their Ts & Cs.

Shortly after, the aircon evaporator split. Having taken all the gas and oil with it, the compressor ran dry for a while, and got very noisy. The supplying dealer took the car back in and resolved both problems; they told me that had fitted a new compressor. I have no way of knowing whether it was brand-new, used, recon or what as they didn't tell me (and to be fair I didn't ask).

Now, that was 6 or 7 months ago. I've had the car 9 months, and I've put around 10k miles on it. The aircon compressor is getting noisy again, although everything works perfectly and the air is nice and cold, so I assume no leaks, or at least no major ones.

So my question is this. I know that I have no recourse to the garage based on the supply of the vehicle. I know that I chose not to take out any warranty, which I'm completely comfortable with. BUT....do I have any grounds to go back to them on the basis of failure of a component which they fitted? And if so, do I ask them to provide me with purchase details so that I can go to their supplier and seek a replacement, or should the garage be expected to replace it themselves?

PLEASE understand that I'm not in any way trying to try it on here, nor am I expecting anything I haven't paid for; I just wonder whether there are any grounds for asking for a "new" part to be replaced if it's failing in less than a year, and how to go about that. So don't shoot me!

It's entirely possible, I guess, that they fitted a used part and therefore there is no warranty at all, and on that basis I guess they have discharged their responsibility to me by repairing the car whilst it was still under the warranty they provided (nothing says they have to use new parts, I guess).

If it was a new part fitted, and it is covered by a manufacturers warranty, then your supplying dealer should be able to get a free replacement. Could be all sorts of arguments about this though. For example, if another part of the system failed or you had a leak, running a compressor "empty" will probably knacker it. That can't be the manufacturers fault.

Let common sense prevail. .
