Help thieving dealers

Any advise greatly appreciated guys , My key stopped working the remote locking as stated else where here , any way Barbagellos the WA dealer looked at the car and said new keys were needed and that it was $1700 I said that is ridiculous and I would pick my car up but when I got there I reasoned they had me over a barrel if I couldn't get keys from the UK so I said ok order the keys I went home and had one more go to initialise the keys and it worked .
So this morning I phone to cancel the keys and after a few hours delay am told the keys are my property and I must pay for them.
The keys are only GBP 125 where they are ordered from in the UK . 2008 MY Supercharged

If you've not paid for them yet, how can they be your property?

If you did pay for them via credit card, contact your credit card company and ask them to record a dispute against the transaction and to stop the payment pending the outcome of the dispute?

Looks like they are really trying to rip you off.

If they misadvised you to buy/order them then I would have thought they cannot force you to pay, that is the angle I would use, also the price they wanted is huge and could be slated in the courts as a rip off. All depends on trading standards and consumer rights of the country you are in. Tom

So get a stop put on the transaction by your credit card company. They can do that.

when i order keys for customers i do explain they are a non returnable item as cut and programmed to your vehicle.
if they didn't make you aware of the above then decline to pay.

they should still be able to cancel them though, what lead time did they give you You can paypal direct using - www.paypal.me/duckworthparts

Well if you at least request that they are cancelled asap (in writing/email), so that even if they refuse you can take them to court in the knowledge that they can be cancelled and the dealer was lying and deliberately delaying to put you at a financial loss. In the UK trading standards would fully support you as a consumer and see the dealer as acting fraudulently. I would also inform the credit card company so they can void or cancel the card/payment before it has gone through.

You might have to take it to court but with evidence from LR UK on timelines and cancellation you would have evidence to back your position and enforce the fact that your dealer is fleecing you. Tom

Looks like good advice. Also, if the keys arrive, don't pick them up. Generally, credit card companies get involved when you pay for something and DO NOT RECEIVE it. If you receive it and, for some reason it's unsatisfactory, that's a different kettle of fish...

If you were able to re initialize the key, there wasn't anything wrong with it and they were wrong to order a new one. Can you get in touch personally with the key cutter/manufacturer and get the order cancelled? You shouldn't have to do that, but it might be easier in the long run.

Hi Axle, as others have advised, get in touch with your state’s consumer protection authority ASAP.

Also do as advised and contact your CC provider. They may have some tricks of their own to help you, but if nothing else, attempting to cancel the transaction, which will delay the process for at least a few days, and might be enough to persuade the company to cancel the new keys.

Also note, there are a couple of commonwealth government departments that now handle consumer protection complains.

I found out about the commonwealth government when I contacted my state’s consumer protection authority about the LRA warranty problems I have had and while they informed me that because of the age of my vehicle, had to be no older than 5 years, but they gave me the contact details of 4 other state and commonwealth government departments that handle this sort of thing.

That worked for me and I am now, through a legal firm, building a case against LRA, so if you get in touch with your state’s consumer protection authority, you might be surprised how much help is now available. 2007 TDV8 Lux

The other thing is, with a proper quote from a reputable supplier like Duckworth, you can also prove that their pricing is very unreasonable. Combined with the fact that they didn't even do a good job investigating the problem as you have actually been able to resolve it yourself.

So they are not only negligent in their duty as a service provider, the case can actually be made that their was malice involved since the problem was so easy to resolve and the pricing of the keys is way out of proportion.

You would still need someone with WA legal experience to write a letter to that effect.

Furthermore you should get involved with the WA government bodies that deal with this and the consumer protection agency that they are likely to have.

The other thing is to send them (the dealer) a formal letter that you DID NOT order any keys and that they should provide you with written proof that you did. In the same letter make clear that you are going to take legal action if they intend to charge you unreasonable prices for an item that you have not ordered.

Sorry to hear, would love to give the b Censored tards a piece of my mind face to face. I really hate people like that, do they really think we are that stupid that we just swallow such bull Censored ????? MY 2010 5.0 SC Galway green and sand interior!!

Good news everybody

Just spoke to the service manager and he say he is flabbergasted it came to this and to rest assured he will cancel all charges . Excellent turn around I feel although he says he is now on the war path with Land Rover because they charge oversees Dealers $600 for their keys . 2008 MY Supercharged

Nice to see the dealer does think of the customer.

BTW, the prices here are set by LRA, not LR in the UK. 2007 TDV8 Lux
