Help needed with Dealer not responding re warranty work

I’ve had the car for two weeks and after a week I got the awful burning oil smell and smoke from the rear of the engine I had just topped the oil but it already had a leak that was picked up on the mot, I contacted the dealer after I took it to my local independent landrover specialist who diagnosed a broken oil cooler as not only is there a oil leak down the back but there is evidence of oil in the header tank, so he quoted to replace with a genuine replacement oil cooler, flush the oil and water and re fill new filter etc £945.00.

I contacted the dealer via email and WhatsApp last Monday as that’s the only way to get in touch it seams, I’ve had no reply to either and I know he has read the WhatsApp due to the double blue ticks, I stated it’s booked in tomorrow and as it’s under waranty and a clearly existing problem this needs to be covered by the warranty, he has had a week and I’ve been in touch several times but nothing no reply at all, the car is going in and as well as this work I’m getting them to change the gearbox filter and oil, transfer box and diffs, I will pay for all the works but where do I stand getting the money for what I feel is justified waranty work.

Any help gratefuly received as I’d rather not shell out almost £1000 when I shouldn’t have to

Google 'sale of goods' act & somewhere in there will be 'fit for purpose' etc etc. If you go ahead & get the work done & present him the bill he may, justifiably, refuse to honour it without him agreeing to it first. I used to be a dealer years ago & would always ask for any problems to be directed to me then I'd sort them. But, if you're getting no joy from him, that's a different kettle of fish. No response to your social media is totally wrong, without naming the dealer, is it a big dealer, franchised dealer, mickey mouse dealer? He must have a 'phone number?
Whatever you do, keep a 'paper trail' of correspondence [whether he answers or not] because if this goes to court you can at least say "look, I've tried my hardest but he's not responding".
A good dealer would say "my mechanic can't fix this, take it to so & so & I'll pay".
Lastly, look on their website and/or the receipt to see if there are any warranty details. I once bought a Cooper 'S' from another dealer & on the receipt was "one months warranty on engine & gearbox but any fault must be returned to us". That's not strictly legal under the sale of goods act, but just check your paperwork.

It's the Consumer Rights Act now, there are time limited rights to reject or get repaired, depending on severity of problem.

In general the seller should be given the opportunity to repair. Getting it done elsewhere leaves the risk of the dealer denying there was anything wrong, that he could have done the work cheaper and so he should not have to pay for the other repairer's work, and hassle about recovery from the seller. Warranty companies tend to have set procedures for being informed of the problem, approving the work and the person to do it etc before accepting liability, so again getting someone just to do the work has risks, even if it is helpful from a perspective of the vehicle being available for use sooner.

He is a registered small motor trader in Birmingham, said verbally it came with a one month waranty but nothing written down on invoice, no replies to any emails or WhatsApp messages and I can see he has read the WhatsApp, I told him about the issue a week ago and send a copy of the quote for works to be done and still no reply, when I bought the car the add said detachable tow bar and electrics but it was missing the detachable we agreed on a payment from him for me to sort the missing ball but it never turned up, so I’m not surprised he hasn’t responded, apart from the oil leak the car is mint and very well looked after with a full service history and big bundle of receipts from the previous two owners so i want to keep it’s a shame he is being a Censored but I need this issue fixed a freind had the same problem and because he didn’t get it sorted it knackered his engine 2012 Range Rover Westminster 4.4 TDV8

For starters, he cannot by law give you just a one month warranty, the law states three months.
I would email-write-contact and say the car “is not fit for purpose” and “ various jobs need doing and if he doesn’t contact you, you will have no option than to get the work done & invoice him for the repairs”.
Garages/traders like this really Censored me off, they’re all fine up to the point of taking your money then they go cold.
Keep a note of correspondence whether he replies or not, then take him to the small claims court as Haylands posted above.
Speak to Citizens Advice & seek their thoughts then start the small claims court procedure. I’ve used them once a long while ago, brilliant experience & fascinating to observe what happens.

A Trap 

The law states you need to give him adequate time, 7 days even with the car off the road isn’t enough. He will be able to make up reasons that stand in court not to pay. If there is a warranty company behind it they always have clauses like, no work to start before they have authorized it or the claim will be rejected. You need to be seen to reasonable, the pandemic may give him lots of reasons to hide and buy time.

You need to send him a letter registered/signed for that states he either needs to respond in a reasonable time (14 days is normally seen as reasonable) first to start the process. State what actions he need to do I.e get in touch, organize inspection and what you will do if he doesn’t respond or comply by that 14(?) day period you will organize repair and start proceedings in small claims court to recover out of pocket fees.

After you have sent the letter go and see him in person. take a witness (police friend, solicitor, someone of standing that can sign an affidavit), be polite but insist on the same time frames as your letter.

Or if everything else is OK with the vehicle and you can afford the hit just get it sorted, you will almost certainly waist a lot of time and could be with out the car for a long period.

Update, so after getting no reply's to any messages i took the Car in and sent the Dealer another message to keep him informed, i could see he had read the message but no reply so today i messaged saying the car will be ready by 4,30 and im taking legal advice to ensure the warranty work is covered, this did the trick i was messaged straight back telling me to call him when collecting and he will pay the garage direct RESULT Very Happy. when i got to the garage i called and handed the phone to the owner and the dealer paid him but not before trying to get a 20% discount for trade Rolling with laughter 2012 Range Rover Westminster 4.4 TDV8
