It’s clearly not an enforceable contract but if you sell it on to a 3rd party, you’ll be blacklisted.

It is unenforceable in law even when you sign. And blacklisting customers for that purpose is against the law.

Really shady practices.

Distribution contracts between two legal entities and the rights associated with that are a bit different than consumer contracts. The intent there is between Rolex AG and their authorised dealers such that the AD is not stocking the grey channel. Something that could affect their consumer customers and affect the brand.

For example I bought mine at my regular AD in the Netherlands a while ago (before the Apple Watch 🤣) and it was way cheaper than buying it from an AD in London. Just like in any industry they just keep an eye out for signs of abuse due to volume sales (amongst other indicators).

Back to JLR. Does anyone actually have a copy of such an agreement that JLR wants consumers to sign?

I suspect a relative small group do it purely for commercial gain. Can’t blame them as supply and demand is the oldest game in town.

But it wouldn’t surprise me If there are others who simply have got something else in the mean time. We ordered an Audi for my wife ages ago, we still don’t know when it will arrive, heck we may even have left this country by then. But as it’s so uncertain I’ve also ordered another car, that is due in a month. If when the Audi becomes available we can do a quick flip. It wasn’t intentional but hey why not. Enough to have a nice free holiday Smile

I can’t see the problem with this. High end used car traders regularly buy new models to sell at a premium to those want to have the latest thing now rather than wait. They take the risk of buying a new car that they think will be in short supply relative to demand. It doesn’t always work out for them and sometimes they will take a hit. It’s just sour grapes by JLR because of the fact they can’t reasonably access this premium themselves. No one loses out. Rich people pay a premium to have something now and traders take a risk for which they are rewarded. Where’s the beef?

@5.0 totally agree. This is one of “such” dealer who always seem to have very nicely specified new cars. Great if you want something quick and can’t be bothered to wait. I wish main dealers could do that or actually specify preordered vehicles in a good combination of colour and spec.

It seems too often to me that they get specified by people who don’t like cars.
