EGR fault code

Gave my 2007 L322 TDV8 3.6 for some regular maintenacnce oil/filters and recieved it with a suprise gift of a P0402 fault code resulting with a Chceck Engine illumination Censored . Just love such situations.

My service guy says it's likely that the RH EGR valve is failing and I'm getting a pending trouble code ...

Strange as before this problem hasn't occured, interesting if it could have developed during the service maintenacne works?
