Can I do anything about it !

I ordered a pair of rear discs online. I entered my car reg number and it came up with the choice of 2 options of front disc, and only 1 rear disc option - so was duly ordered Thumbs Up
Arrived next day (as I'd paid extra for this service), which just happened to be recycling bin day - so I thought it would be a good idea to get rid of all the packaging.
Later that day I came to fit the discs, and completely wrong !!

So straight on the phone, and they say they can't do anything about it as I've thrown the packaging away...

So I've got a brand new set of discs in the garage, I can't sell them as I don't know what they fit - and I'm about £75 out of pocket... Big Cry

I take it you paid by credit card? I would contact them and say the wrong item was sent. It is not unreasonable to damage packaging whilst removing a product. As long as the discs themselves are unused they should take them back. At the end of the day their website gave duff info to you.. Thumbs Up Previously..

They say I should have checked them BEFORE I threw the packaging away..

I did have a quick look - The disc was the same, the stud pattern was the same, but the hand brake drum was around 15mm bigger, so no handbrake Shocked

I then went to local motor factors (which I should have done do start with) and they got me the correct ones straight away.

Refer them to http://www.oft.gov.uk/shared_oft/business_...oft698.pdf in particular 3.44 to 3.49

Original packaging is missing as you needed to remove it to inspect the goods.

The goods were not as described, as evidenced by the fact they dont fit your model of vehicle, hence you are returning them for a full refund under the Distance Selling Regulations (although in law DSR's give you a blanket right to cancel and return without giving a reason)

Give them a reasonable period to process your refund and inform them that you will take the matter further with the OFT, local trading standards and your card issuer if they fail to refund you in full (read the leaflet - postage costs are covered by the supplier)

I'm assuming you purchased using a card. Good news is debit and credit card purchases are covered by DSR's.

I'm not 100% on this, but usually the card issuer is jointly liable with the supplier for compliance with all applicable regulations (although in practice they will just charge the supplier!)

Hope that helps Thumbs Up 2007 Zermatt Silver TDV8 Vogue SE - now sold but was a great car!

Thanks, that's really helpful Bow down

email sent off to them (referring them to the above), now wait and see what happens ..

So even though their T&C's state must have original packaging - they can't get away with it ?

Just got mail saying

Dear customer ,

Thank you for your email , I am sorry to hear of the issue you have had with your order, unfortunately, once the parts have been fitted, we would not be able to accept the order back.

Please see our terms and conditions :

http://www.************.com/terms-and-conditions

If you have any other queries, please do not hesitate to contact us .

Kind regards,

So looks like by fitting them I've lost out Shocked

A bit annoying as they did look the same until they were fitted, and the only difference was the handbrake drum was around 10 - 15mm larger diameter. + They told me these were the ones I needed.

One things for sure, I'll use local suppliers in the future...

I wouldn't be happy with that reply. Banging Head I'm not familiar with UK regs, but the advice in the above posts sounds good. Also, going up the chain of command may work. Once they realize that sending you the proper part is the easiest and cheapest solution, they'll do it (hopefully). Unfortunately, it's a pain! Censored Censored Censored

They're saying, "We sent you the wrong part, but it's similar enough that you won't know until you fit it. And once you fit it, you can't return it." Evil or Very Mad

Not suitable for intended purpose.

If they said they would fit the car and they didnt fit then the fault is theirs and not yours.
Doesn't matter if fitted or not.

I'd say give them that one more chance quoting along the lines above and if not just Name and Shame them.

Then post them up for sale as someone may have them off you so you don't lose too much money Smile FFRR MY06 facelift With TDV8 Alloys Zeros/ATR's

I've emailed them this morning, and advised that Trading Standards will be my next option.

Trouble is, I can't sell them as I don't know what they do fit Rolling Eyes
