A word of caution.
'Fault' in insurance parlance is deemed whether they can recover their outlay or cannot. So for example - you get hit whilst parked - inconclusive witnesses - goes down as 'at fault'. It's not a no blame bonus its a no claim bonus. So if you make a claim and they can't get back what they pay out then it will go against you.
In this circumstance it appears if he's been cautioned then he is 'tangible' - so the theory is that if, as you say, he has the means to pay - then they could recover their £4.5k outlay from him.
In practice though - being able to actually get it, before renewal time, is another matter.
I wouldn't be keen to replace it for him to do the same to the new one - where does it end?
