Returning/backing car within 14 days where do I stand.

Hi guys and gals need some advise, had a search but was unable to find much.

Reserved a 66 plate autobiography from main dealer that popped up at an unbelievable price via LR web site, got a call to say was supposed to be plus VAT so I thanked them but said I was no longer interested (I had already agreed in principle another car) anyway got a call from the sales manager who offered to split the VAT and give me £4k off in the black Friday offer. I accepted the deal, paid my deposit and arrange to collect the car the following week. I went to collect the car and sorted all the paperwork even before looking at the car as I'd bought from them before and I've seen plenty of black RR to know what it would look like. Finally I was taken to the car, given some flowers and an umbrella and got on my way after turning down instructions on how to drive the car.

I forgot to mention at some point I was informed that the car was previously sold but the purchaser was unable to arrange finance and that is why the car had come back up for sale, if you read down further you will understand why I now think this was a lie.

I picked the car up on a Tuesday and got a call on the Thursday day asking if everything was okay, my reply was yes everything is fine well it was until on Friday I thought I heard a weird noise when I was turning around on some loose stone. Saturday and I'm driving off of a loose gravel track onto a tarmac road and a noise came from the back of the car that sounded like one of the back wheels was about to be ripped off. This happened a couple more times pulling out of junctions, I didn't stress as I thought I will just send the car back as it's within 14 days.

I no longer want to keep the car as I know I will now worry that something else will go wrong or the repair will not last etc etc. I'm still within the 14 days that I can cancel the credit but the garage have suggested I can only have an exchange but obviously they do not have the same car at the same price or another car that takes my fancy.

Where do I stand legally? or does anyone have any experience where they have been successful in a similar situation?

I think before you reject you have to give the garage a few goes at trying to sort the issue.

If you like the car why not give them the chance. If the noise disappears you’ll know they’ve sorted the issue Thumbs Up

Have a look at the Consumer Rights Act 2015 (via Google or similar) and maybe Citizens Advice summary.

There is a right to reject/return within 30 days, but it can only be exercised where a reasonable person would not regard the car as being of satisfactory quality (there are various additional details). There is also a right to require repair, and a right to reject if the dealer cannot do so, having been given a reasonable opportunity, and without significant inconvenience to the buyer. There is quite a lot of detail and you may need to take legal advice if you cannot agree a way forward with the dealer.

The requirement for reasonableness generally means that one cannot reject for matters that a reasonable person would regard as more a matter for a repair than outright rejection. Some dealers do give an additional contractual right to give cars back in a short period, that does not affect the statutory rights, you might check their terms and conditions about that.

On personal experience, my 2012 WM needed a new gearbox eight days after I bought it. That was material enough for rejection. However, at the time it was very hard to get a comparable car and there was a long wait for a 405, so I agreed they could repair. I was then told that no gearboxes were available (on back order) and there was no indication of when one would become available. The position on supply of a hire car was also unsatisfactory. I threatened to reject the car (in writing, with citation of the relevant sections of the Sale of Goods Act which applied in those days) and Lo! a gearbox appeared and the car was fixed by the end of the week. That was the best outcome and also offered the advantage of maintaining a good relationship with the dealer, valuable in case one needs a favour some time later. I thought it fair and reasonable in the circumstances. Fairness and reasonableness will, I think, be important if the matter comes to court.

My guess is that the easiest way forward for you is to give the dealer a chance to repair within a reasonable period, but on the basis that you will exercise the right to reject if they don't do it by the reasonable deadline and without excess inconvenience to you. Keep it polite and calm and communicate in writing or record what was said in writing to the dealership. Involve Land Rover Customer Relations if the dealer is unreasonable.

Great advice there. My tuppence, never phone, always email , as there has to be a proven trail. Unless you record calls, it's the only way should problems arise further down the line

We had a situation a few years back with a 2009 Nissan Pathfinder.

A fault was identified and the dealer in question attempted to repair it on three occasions but to no avail, only then did we reject the car and received a full refund. But had to follow the process to the letter.

Funnily enough I wasn’t ‘allowed’ a RR at the time as they are ‘unreliable’ the Nissan pretty much blew up! We now have an RR...I won. 2012 4.4 TDV8 Westminster - Baltic Blue, Jet interior

I’ve rejected a D4 and LR financial services (Black Horse) did it all for me, having got nowhere myself with the dealer and LRCS.

So all corespondents have been emailed and I’ve had a look at the legal side. I’m trying to resolve amicably but will instruct the credit company if necessary.
To top it all the car went into limp mode last night which I took a photo of as evidence.
What drives me mad is that the garages know your rights but try to advise you differently subsequently you no longer trust them.

Garage accepted car back today after diagnosing a problem with the diff. I know some will say I should have had the car back after it was repaired but something just didn't feel right so I've walked away. It will be interesting to see if the car ends up back on the forecourt or gets traded on.

I wonder if it's feasible to create a rogues gallery of cars (registrations and descriptions) that have been returned because of unresolved faults?

It could serve as a resource for potential new buyers and ensure they were aware of any issues reported by members before they purchase.

A bit like a lemon register. Not sure if it's legal, but could be a valuable resource for members.

What do you think Stan/Martin?
