Threaten them with your legal costs as well, it might bring them to reality that they will not be able to retain the car a bit quicker, unless their solicitor is a twonk

How were the DVLA able to issue a new V5?

Even if it wasn't listed as stolen I thought they sent a letter to the owner on file if a new V5 was requested other than by the registered keeper.

OR

You get a letter when the registered keeper is changed.

Either way you should have had correspondence from the DVLA, they've had a few systems fail somewhere that I'd want answers to. Current

I find it amazing that the other side have lawyered up given that they’ve bought a stolen car without doing any checks.

Can you get to see the condition of the car before you get heavily involved with legal fees?

Having just been through court with a neighbour and now trying to recover nearly £20k, it’s amazing how quickly legal fees start to mount up.

I hope everything goes your way quickly. I also don’t see how the other party has a chance of winning.

It looks like one or more databases were not updated that the car was stolen.

Therefore, the person who applied for a new V5 may have carried out various checks which of course came back as "clear", so he/she may be an innocent party (the guilty being further back down the line).

Be interesting to carry out a check now.

I think I would be submitting a formal complaint to the DVLA about this. They've completely dropped the ball here and been utterly negligent. 2000 P38 4.0 HSE auto - RHD - just needs a little love.

I've just had the exact same thing happen. the car is a Merc convertible and was with a garage to have some work done. It was kept in a 'secure' CCTVd/guarded compound at a commercial enterprise with 4 guarded gates. Recently I was advised that someone had requested a new V5. I told DVLA on the phone that under no circumstances were they to issue a new V5 as the car was still mine, was in a garage being worked on and was obviously being fraudently usurped. Eventually they said I had to produce evidence that the car was in my possession by photographing the VIN from inside etc. I was actually working away in Oman at the time so I asked the garage owner to do the photos. unfortunately he never got round to it and promised to have the work done by last Xmas. I phoned him last week to say I would be collecting the car in a few days and he said he would go and collect the car from the 'secure' compound, and lo and behold then tells me it wasn't there and was most likely stolen. apparently one of the gates' CCTV had broken!

I then checked tor MOT tax and Insurance and turns out V5 was changed in October last year and it is full insured and taxed by someone. police are refusing to release the new V5 owner details but I am going to push to ask them to reclaim the vehicle.

Any advice anyone?

Police have been informed by the garage and I have been told to inform the police.

I'm interested as to why the Police have held on to it, you have clear title and ownership. Have you been able to see the car yet?

the police may be holding on to it for a few reasons, for example
to recover forensic evidence (unfortunately this will be a slow time job as the 'scene' is now secure and preserved)
if it was involved in a serious crash, case law (R v Beckford) will apply and it could be held for a long time
they've forgotten they have it/lost in the system (police recover hundreds of cars a day of many reasons)
they are making enquiries as to who owns it so it can be returned to the correct person. Again, sadly a slow time task.

There may be other reasons but I'm not a cop anymore and am putting that life behind me Smile First time FFRR owner
