new right to attack burglars

Read this today and thought, about bl00dy time the issue gets clarified.
I like the thinking of Chris Grayling that a homeowner can use disproportionate force in the heat of the moment.

Would that be the outcome? Is there no (or a significantly lower incidence of ) burglary in Texas? If so it would be really good. If instead all burglars get tooled up and shoot/stab/bash anyone they find in the house before they start just to be safe then all thats been achieved is an escalation of violence, which for the innocent majority would turn out worse.

It all depends on who you think would have the upper hand. I'm reasonably big, reasonably fit, and would be able to give a reasonable account of myself if I lost it.....but my guess is I'd more likely be scared witless and useless in a real attack. Most of the time (!) when in my own home I dont have ready access to any sort of weapon, whereas an intruder may well have prepared themselves. I'm not familiar with the situation, whereas the intruder does it for a pasttime. So its got to be right that the homeowner gets proper protection from presecution....and it would definitely be a bad idea to try to burgle my ex-marine brother-in-law...but I dont actually see it helping me very much. Mike - MPx

You can use almost anything as a reasonable weapon if you can improvise on your feet... Think Jason Bourne and you'll get the picture!!

Lamp shades are good and my ex always used to have a knife to hand for some odd reason so it stands to reason that fatty wont get robbed anytime soon! FFRR MY06 facelift With TDV8 Alloys Zeros/ATR's

I think it is a good development that you won't get prosecuted in conditions as described. If I would wake in the middle of the night, I may not be the most rational person (will anyone be ???) and I think it is hard to be "controlled" in such conditions.

On the use of guns, I am quite hesitant, because of a number of things. First of all your aim will be quite crap after just waking up, having a "near ready" gun around the house when you have kids is foolish in my opinion, the risk of accidentally shooting family and friends is statistically quite big, having the gun turned against you (you're sleepy and hyped at the same time with the thief being awake and alert and hyped as well) is a big risk etc. etc. etc.

I have been "playing" with handguns for more than 25 years, in so called action shooting (have a look at YouTube search on IPSC), and I would not feel comfortable using it in real conditions without continued and specific training. So having people that don't have this training (read 99.99% of the population) using guns to "defend" themselves is not a good proposition IMHO. MY 2010 5.0 SC Galway green and sand interior!!
Have the Faultmate MSV2 Extreme to be tinkering with the settings etc. !!

I was eluding to the law point of view in Texas, meaning that you can do anything on your property to defend yourself.
Granted, using a gun to do so may be extreme and not everyone is comfortable or competent with guns.
Use a 4 iron, baseball bat, bread knife of weapon of choice instead. Wink
Seriously, if a burglar is at our house at any time of the day, I will want to make sure that no harm will come to my family.

It's not really a right to attack, as that could be seen as "grossly disproportionate" action (e.g. stab/shoot them in the back). It's more along the lines of you are allowed to defend yourself in whatever way you deem necessary at the time, but this does not give you the right to attack them if they are fleeing.

Personally I am a little worried about how this story is being reported as it appears to be giving people the idea that they can go a bit Pulp Fiction on intruders (Remember the scene with the line: "Bring out the gimp"?). That said it's nice to know if you find someone in your house you can give them a little bit of a kicking without going to jail yourself. I view breaking their legs and arms a right to defend myself against some intruders! They cant attack you once they are down can they Smile

Ex attacked me with a knife a fair few times and said that me pushing her back was disproportionate and the police refused to press charges against her as i had possibly used unreasonable force!

KP, you probably need to get stabbed half to death before it will fly in court. You are the man and in the mind of most judges and juries you are still the stronger person, new law or not.

got to be careful
Couple of weeks ago I caught six little Censored On my drive interfering with the FF chased and caught two. ( yes stupid i know but you just react you only think about knives and being outnumbered later)
Gave them a round of Censored s then carted them off to the local police station which was closed of course no answer on phone or intercom system there for emergency use!!
luckily my son was able to identify the youths all 15 one 13. the ringleader being ex next door neighbours son.
No damage caused to car because I caught them early so decided to not bother plod went and saw parents thinking it would be delt with how I would deal with my kids.

Next day old neighbour came round to talk about it.
I think we are getting an apology and a thanks for not calling plod next thing he is telling me how it is wrong I chased them 'hunted tham down is the phrase used' and how upset they were!!!!! Censored me threw him out told him to get real they were only upset becasue they got caught, next day Plod turns up investigating a case of assault on the two I carted to the nick.
arrested in front of my children interviewed for two hours they were not interested in the fact I had stopped some criminal damage taking place just that I had grabbed hold of the little darlings!!
I might add I am an ex police officer, school Governor, CRB checked because I sometimes cart Scouts about and have never been arrested or in any trouble with the Police.
They decided there was no case but it was not a nice experience.
The follow up to this is a few days later the mother of the ringleader deliberately tracked my wife down to a local supermarket then approached her on the carpark opened the car door stood so the wife could not close it and abused her we reported it to plod as we were advised to do after the other incident. it took three calls before they bothered to call back then spoke on the phone not a visit to take a statement and gave an assurance that they would speak to the mother and warn her that if she does it again its harrasment and she would be arrested.
That was a month ago the officer has not called back or confired that she has delt with the incident arnt the police brill.
So dont go settin about anybody with a baseball bat just yet! Mine was a blue one! Smile

Way I see it if you're on my property and shouldn't be you will know about it before you're head hits the floor!

I feel for you Andy Sad

I spent 6-7hours giving a long statement in a police station about what the ex did and got assurances that even though I was a fella I would be dealt with fairly!
Not a pip for ages and ages until I chased it following through the advice of a member on here(thank you again Smile )
I've been in scouting for nearly 20years and a leader since i was 16! I'm HO cleared and DV cleared as well as enhanced CRB.

She has then accused me of hurting her and all sorts and now social services in Doncaster think I'm a risk to be near my own child and that I possibly raped her from the reports she has given! Need I add that at no point have any charges been placed against me other than a warning not to phone or go to the marital home after she phoned me loads and I sent a few messages back, that were extremely polite! She's a complete crack pot who has done drugs in the past and has been an alcohol abuser yet she is still allowed to teach kids when i know she has turned up for work drunk and covered it up to her management and colleagues and got away with it! I'm left fighting through the courts while she lives off handouts from her parents for anything she wants and pay her huge legal bills to delay me seeing the nipper! Doubt I'll get to see him at all before xmas and at the end of the day he is all i care about now. I just wish when i left i could have taken him with me but not thinking clearly and with police all over the shop I just complied and left Sad

I lose hope with the way the law is processed at times and its blatant bias in some cases where evidence suggests another course of action should be taken Sad

I read up the other day on some stuff and found out some fathers have committed suicide as they lost hope Sad

Think I could do with a euro millions win and then employ a super expensive legal bod to slam dunk it!
